Topic: The Role of Codes of Conduct under the GDPR – Can Co-regulation do the Trick?
Abstract: The GDPR entails a challenging combination of characteristics: Rather vague rules and severe consequences of breeches of those rules. One way to substantiate the flexible terms of the GDPR are codes of conduct under art. 40 and 41 of the GDPR. Codes have not been a success story under the current regime. The talk will highlight the new features under the GDPR, carve out the preconditions and explore fields where codes of conduct might be the solution. To achieve that the code system will be analysed against the background of research on co-regulation in general. The lecture will also address the role of monitoring bodies beyond their function of guaranteeing the compliance with a code of conduct.
